The purpose of these general terms and conditions (hereafter the "General Terms") is to set out the terms and conditions under which AHM Gestion allows its clients (hereafter the "Client(s)") to benefit from all the services, particularly reservations, available on this website and described below (collectively referred to as the "Services").
Before any Service reservation on the site, the Client declares (i) that they are acting for personal reasons that do not fall within the scope of their commercial, industrial, craft, liberal, or agricultural activity, and (ii) that they possess full legal capacity allowing them to commit to these General Terms.
It is strongly recommended for the Client to carefully read and save a copy of these General Terms as well as the Specific Conditions unique to each establishment.
AHM Gestion reserves the right to modify or supplement the General Terms at any time. The new version will be available on the site with its effective date. Clients are advised to regularly check the General Terms to be informed of any changes. However, the Client will only be bound by the version in effect at the time of the Service reservation.
The View SERVICES
The services offered by AHM Gestion on the website www.theviewhotels.com include two types of services: Accommodation Services for booking hotel rooms or other types of accommodations and Additional Services. The Accommodation Services and Additional Services are jointly referred to as " The View Services".
The site allows clients to book rooms at The View hotels. Essential characteristics of the establishments, their availability, prices, options offered, payment conditions, and specific sales conditions applicable to the chosen rate (such as guarantee policies, cancellation terms, check-in times, member rate conditions, etc.) are presented during the booking process described in BOOKING PROCESS below.
Note that each Establishment has its Specific Conditions of sale applicable to the selected rate, also available on the site. The Specific Conditions are shown to the Client before any reservation and may include details such as check-in and check-out times, guarantee policies, cancellation deadlines, Wi-Fi access, and specific conditions for children.
The site also allows the booking of Additional Services, such as breakfast upon the Client's arrival or an upgrade of Accommodation Services, or a spa treatment (subject to the Specific Conditions set by the Establishment). Additional Services also target travel services that may form with the Accommodation Services either a "travel package" or a "tourist package". This information is communicated to the Client before booking these services in the Specific Conditions specific to each offer. The reservation of a combination of travel services such as accommodation, transport, car rental, and other tourist services (tours, excursions, experiences, etc.) may constitute a linked travel arrangement or a tourist package.
Reservation of a car rental offered within 24 hours after booking an accommodation Service.
A massage or facial treatment.
AHM Gestion establishes partnerships and distribution contracts with third-party websites ("Partners") to allow the Client to search, select, and book rooms in AHM Gestion establishments on the partner's website (hereafter the "Partner Services"). The sales conditions applicable to these Partner Services are available on the Partner's website.
The process provided on the site allows the client to choose any service presented to them.
RESERVATION OF SERVICES
AHM Gestion customers can make reservations for The View Services via the website. The reservation process may vary depending on the navigation and request of the client and consists of the following steps:
Providing search criteria for the destination, establishment, and additional services if needed.
Viewing the results and selecting the establishment and additional services where applicable.
Reviewing details and features of the selected services, especially for accommodation. This includes information such as room size, amenities offered, length of stay, breakfast and wifi options, the total price of the booking, applicable taxes, and any specific terms, such as cancellation policies and check-in times.
A summary of the reservation with the main features and provision of the client's contact details to create a member account on the site or a loyalty program offered by AHM Gestion.
Completing the reservation by entering payment details and accepting the general and specific conditions of the reservation.
Sending a reservation confirmation email to the client summarizing the booking details and the accepted terms.
PRICE AND PAYMENT PRICES
Prices for booking the Services are displayed during the booking process. For Accommodation Services, prices are shown per room for the selected date and number of people. Once the reservation is confirmed, the total inclusive price of the Service is indicated to the Client in the establishment's trading currency, which may differ from the local currency. This price is only valid for the duration specified on the Site. If the charge is made in a different currency than that confirmed at the time of booking, exchange rate charges are the client's responsibility. Any currency conversion displayed on the Site is purely indicative. The tourist tax must be paid directly to the establishment, except in the case of online prepayment where it may be included in the total amount. Prices include VAT in force at the time of booking, but any change in the VAT rate will automatically be passed on to the invoiced price. Any new tax imposed by the competent authorities will also be automatically added to the invoiced price. Finally, some promotional offers are only available on the Site and cannot be purchased at the establishment's reception.
PAYMENT GENERAL PROVISIONS
The client must provide their payment information when booking on the site, either to prepay the booking before the stay or to guarantee the reservation. The client must enter their credit card information directly into the designated area, without spaces between numbers, in a secure SSL encrypted entry. The cardholder's name, credit card number, and expiration date must be provided for prepayment via payment platforms chosen by AHM Gestion. Payment partners will conduct a validity check of the client's payment card, which may be declined for various reasons such as a stolen or blocked card, a limit reached, or an input error. In case of an issue, the client should contact their bank and the establishment or any other entity to confirm their reservation and payment method. If payment is made at the establishment or any other entity, the accepted payment methods may differ. The establishment may also request an ID to prevent credit card fraud.
Advance payment refers to any amount paid by the client at the time of booking. For advance payment, the amount debited corresponds to the total amount indicated during booking (including all applicable taxes, except for tourist taxes) and, where applicable, the cost of options selected by the client, as described in section ADDITIONAL SERVICES above.
CREDIT CARD GUARANTEE
A reservation guarantee by credit card means that the client's payment details are taken during the booking. The client's credit card is not charged, and payment for the stay is made directly to the establishment on the day of arrival or departure, depending on the establishment's terms, unless the client doesn't show up and hasn't canceled their reservation according to the cancellation conditions applicable to the booked rate.
NO-SHOW BY THE CLIENT
If the client does not show up on the first day of their reservation for an Accommodation Service, the establishment will completely cancel the client's reservation and put the reserved Accommodation Services back on sale. If the booking was non-cancellable, non-exchangeable, and/or non-refundable, the establishment will retain all amounts paid by the client. On the other hand, if the booking was cancellable, exchangeable, and/or refundable and guaranteed by credit card, the establishment will charge the credit card provided during booking the total amount of the first reserved night and cancel additional nights at no cost. In this case, the client will not be entitled to any refund or compensation, and the establishment will put its rooms back on sale. For prepaid non-cancellable, non-exchangeable, and/or non-refundable reservations, the debited amount includes the total amount indicated during booking, as well as the price of the options selected by the client according to section ADDITIONAL SERVICES above
CANCELLATION OR MODIFICATION OF A SERVICE RESERVATION
The terms of cancellation and/or modification of the reservation are specified in the Specific Conditions for each service reservation. Prepaid reservations are not modifiable and/or cancellable, and the deposits are non-refundable. However, cancellation or modification can be made through our customer relationship center or directly with the establishment. If the client interrupts the service, the agreed price will be fully collected, with no refund in case of prepaid booking. Unless otherwise stated in the Specific Conditions, the client must vacate the room before the departure time indicated by the establishment. Otherwise, an additional night will be charged.
CLIENT ENGAGEMENTS AND RESPONSIBILITIES
The Client assumes responsibility for choosing the Services offered on the Site, according to their needs. Consequently, AHM Gestion cannot be held responsible for this selection. The Client is also responsible for providing accurate information and should not communicate misleading or fraudulent information when creating their account or when booking a Service. Moreover, the Client is responsible for the use of their account, even if it's used by a third party, and must immediately report any fraudulent use of their email address to AHM Gestion. If the Client fails to comply with these General Conditions, they are liable for any damage caused to AHM Gestion or third parties and must compensate AHM Gestion for all resulting costs. By booking a Service, the Client agrees to pay the price and comply with the Specific Conditions. Any irregular, ineffective, incomplete, or fraudulent booking or payment will result in the reservation being canceled at the Client's expense, and AHM Gestion may take actions against them. The Client must respect the rules of the Establishment and must not disturb its operation or compromise its security. Minors can only stay in an Establishment when accompanied by an adult and with personal identification. Furthermore, the Client should not use the Establishment's computer resources for illegal or unauthorized purposes. The Client must also follow the internet access provider's security rules.
AHM GESTION ENGAGEMENTS AND RESPONSIBILITIES
AHM Gestion commits to providing access to the site and services in accordance with the general conditions and to diligently remedy any reported malfunction within reasonable limits. However, AHM Gestion can temporarily suspend the site for technical maintenance reasons without prior notice. The client acknowledges that AHM Gestion cannot be held responsible for inconveniences or damages related to internet usage, particularly concerning data transmission or network malfunctions. AHM Gestion is not responsible for the content of third-party websites accessible via hyperlinks on the site.
FORCE MAJEURE AND RELOCATION
Neither party can be held responsible for non-performance of their obligations due to force majeure. The parties agree that force majeure suspends the execution of their mutual obligations, and each party bears the resulting costs. If the force majeure lasts longer than thirty (30) days from its occurrence, these General Conditions can be terminated by either party without any claim for damages. In cases of force majeure, exceptional events, or impossibility to provide the Service, including making the reserved room in the Establishment available to the Client, the Establishment can decide to accommodate the Client, in whole or in part, in a similar category Establishment or provide a similar Service, subject to the Client's prior agreement.
CONTACT, CUSTOMER SERVICE, AND COMPLAINTS
To book a Service available on the Site or for any questions related to a booked Service, such as requests for additional information, booking modifications, or cancellations, the Client can contact our booking center at 0529080808 or by email at email@example.com. If the Client wishes to provide feedback or file a complaint about a Service booked on the Site, they can contact customer service by phone at 0529080808, email at firstname.lastname@example.org, or using the contact form available on the Site. When communicating with customer service, the Client commits to remaining courteous and refraining from making derogatory remarks about AHM Gestion, the Establishments, group entities, or employees and collaborators. AHM Gestion reserves the right to take appropriate measures in the event of harmful or reprehensible behavior (especially upsetting, malicious, or insulting) towards AHM Gestion, the Establishments, group entities, or its employees or collaborators.
By electronically accepting the General and Specific Conditions and entering the required bank details, the parties enter into an electronic contract, which proves the booking of the Service and the amounts due as a result of said reservation. The General and Specific Conditions express all obligations of the parties, and no other conditions communicated by the Client can be incorporated. In the event of a contradiction between the Specific Conditions and the General Conditions, the Specific Conditions will take precedence for the obligation in question. If there's a conflict between a partner's general conditions and these General Conditions, the provisions of these will be the only ones applicable for the obligation in question.
