PREAMBLE TO THE GENERAL TERMS AND CONDITIONS

These General Terms and Conditions (hereinafter the “General Terms”) define the terms and conditions under which EXPERIENCIAH enables its clients (hereinafter the “Client(s)”) to benefit from all services available on this website, including booking services (collectively referred to as the “Services”).

Before booking any Service via the website, the Client declares that:
(i) they are acting for personal purposes outside the scope of any commercial, industrial, craft, liberal, or agricultural activity; and
(ii) they possess full legal capacity to enter into an agreement governed by these General Terms.

Clients are strongly advised to read carefully and retain a copy of these General Terms and any Special Conditions applicable to each establishment.

EXPERIENCIAH reserves the right to amend or supplement these General Terms at any time. The updated version will be available on the website and will specify its effective date. Clients are encouraged to consult the General Terms regularly. However, only the version in effect at the time of booking shall apply.

DESCRIPTION OF SERVICES

SERVICES

The services provided by EXPERIENCIAH on the website www.theviewhotels.com include two main categories:

Accommodation Services – for booking hotel rooms or other types of lodging; and

Ancillary Services, jointly referred to as the “Additional Services.”

ACCOMMODATION SERVICES

The website allows Clients to book rooms in “The View” hotels. The essential characteristics of the establishments, their availability, prices, options, payment terms, and the special conditions applicable to the selected rate (including guarantee policies, cancellation terms, check-in times, and member-rate conditions) are presented during the booking process as detailed in the “Booking Process” section below.

Each establishment has its own Special Terms of Sale available on the website prior to booking. These may include details such as check-in/check-out times, guarantee policies, cancellation deadlines, Wi-Fi access, and conditions applicable to children.

ANCILLARY SERVICES

The website also allows Clients to book Ancillary Services, such as breakfast upon arrival, room upgrades, spa treatments (subject to the establishment’s Special Terms).

These Ancillary Services may also include travel services forming part of a “travel package” or “package holiday.” Information regarding these combinations is provided to Clients before booking, within the relevant Special Terms.

For example:

Booking a rental car within 24 hours of booking accommodation;

Booking a massage or facial treatment.

PARTNER SERVICES

EXPERIENCIAH enters into distribution agreements with third-party websites (“Partners”) enabling Clients to search, select, and book rooms in EXPERIENCIAH establishments directly through Partner websites (“Partner Services”).

The applicable terms of sale for such Partner Services are available on the Partner’s website.

BOOKING PROCESS

The website allows Clients to select the desired Service by following a structured booking journey comprising the following steps:

Entering search criteria (destination, establishment, and optional Ancillary Services).

Viewing results and selecting the desired establishment and any Ancillary Services.

Reviewing details and features of the selected Services (room size, amenities, duration of stay, breakfast and Wi-Fi options, total price, applicable taxes, and special conditions such as cancellation policies and check-in times).

Reviewing a booking summary and entering personal details to create a member account or join a loyalty program.

Finalizing the booking by providing payment information and accepting the applicable General and Special Terms.

Receiving a booking confirmation email summarizing the reservation details and accepted terms.

PRICES

Prices for Services are displayed during the booking process. Accommodation rates are shown per room, per selected date, and per number of guests.

Once the booking is confirmed, the total price including all applicable taxes is displayed in the establishment’s trading currency, which may differ from the local currency.

If payment is made in another currency, the Client bears any currency conversion fees. Currency conversions shown on the website are for informational purposes only.

Tourist taxes are payable directly at the establishment unless prepaid online.

Prices include VAT applicable on the booking date; any change in VAT rate will automatically be reflected in the invoiced amount.

Promotional offers available exclusively on the website cannot be purchased directly at the establishment’s reception.

PAYMENT TERMS

GENERAL PROVISIONS

Clients must provide payment details upon booking, either for prepayment or as a booking guarantee.

Payment data are entered securely (SSL encryption).

The payment service provider verifies card validity. In case of refusal, the Client must contact their bank or the establishment to confirm the booking.

If payment is made directly at the establishment, accepted payment methods may vary. The establishment may also request identification to prevent credit card fraud.

ADVANCE PAYMENT

Advance payment refers to any sum paid at the time of booking.

The debited amount corresponds to the total booking price (including applicable taxes except tourist tax) and any selected options.

CREDIT CARD GUARANTEE

Providing a credit card guarantee means that the Client’s payment data are collected upon booking but the card is not immediately charged.

Payment is made directly to the establishment upon arrival or departure, unless the Client fails to show up without canceling according to the applicable cancellation terms.

NO-SHOW POLICY

If the Client fails to arrive on the first day of booking, the establishment will cancel the reservation in full and re-list the rooms.

If the booking was non-cancellable and non-refundable, all prepayments will be retained.

If the booking was cancellable and guaranteed by card, the establishment may charge the first night including taxes and cancel the remaining nights without charge.

CANCELLATION OR MODIFICATION

The terms for cancellation and/or modification are specified in the Special Conditions of each booking.

Prepaid bookings are non-cancellable and non-refundable unless otherwise stated.

If the Client shortens their stay, the full amount remains due.

Unless otherwise stated, rooms must be vacated by the check-out time; otherwise, an extra night may be charged.

CLIENT’S OBLIGATIONS AND LIABILITY

The Client is solely responsible for selecting Services according to their needs and for providing accurate information.

The Client is responsible for all use of their account, even by third parties, and must report any unauthorized use.

The Client must comply with establishment rules and not disturb operations or compromise safety.

Minors must be accompanied by an adult and present valid identification.

The Client must not use the establishment’s internet resources for unlawful purposes.

EXPERIENCIAH’S OBLIGATIONS AND LIABILITY

EXPERIENCIAH undertakes to provide access to the site and to correct reported malfunctions within a reasonable timeframe.

The website may be temporarily suspended for maintenance without notice.

EXPERIENCIAH is not liable for Internet-related risks such as data transmission failures or viruses, nor for third-party content accessible via hyperlinks.

FORCE MAJEURE AND RELOCATION

Neither party shall be held liable for failure to perform obligations due to a force majeure event.

If such an event continues for more than thirty (30) days, either party may terminate the agreement without damages.

In case of force majeure or impossibility to provide the reserved Service, the establishment may relocate the Client to an equivalent category establishment or provide a similar Service, subject to the Client’s prior consent.

For comments or complaints, Clients may contact customer service at the same number or via email at contact@theviewhotels.com , or through the contact form available on the website.

Clients must remain courteous in their communications. EXPERIENCIAH reserves the right to take appropriate action in case of abusive or inappropriate behavior.

MISCELLANEOUS

By accepting the General and Special Terms electronically and entering payment information, the parties conclude an electronic contract evidencing the booking and payment obligations.

These Terms constitute the entire agreement between the parties. In case of conflict, the Special Conditions shall prevail.

By accepting these Terms and using our online services, you consent to the processing and, where applicable, transfer of your personal data for the purpose of service execution.
